Mediation is becoming an increasingly popular method for resolving disputes that would previously have been fought out through the Courts. The process is flexible, confidential and almost certainly cheaper in terms of time and legal costs than the alternative of going to Court.

Another alternative to going to Court is for disputing parties to take their case to arbitration. Intended to be quicker and cheaper than Court Proceedings and arbitrator will decide the outcome of the dispute, generally based on evidence presented in accordance with rules agreed between those parties and the Arbitrator. Experience

 

Neil Goodrum has a national reputation as an experienced lead Mediator and has acted in this role in many disputes involving employment, commercial litigation, professional negligence, commercial property, clinical negligence and personal injury.

 

Neil works in close association with the Centre for Effective Dispute Resolution (CEDR) being a member of the CEDR Direct panel of Mediators. As a member of the CEDR Training Faculty he is actively involved in training new mediators.

 

The range of mediation activities are demonstrated by the following examples:

 

  • Commercial contract – dealing with a dispute regarding the provision of services to a substantial commercial undertaking, involving issues of agency, breach of contract and valuation where the amount in dispute totaled £1 million.
  • Commercial property – dispute regarding the contractual arrangement and valuation of commercial property where the amount in dispute exceeded £1.5 million.
  • Employment – a dispute between a Senior Executive and a nationally known substantial commercial organisation involving allegations of breach of contract and personal injury where the amount in dispute exceeded £2 million.
  • Partnership/ commercial contract – disputes between a professional partnership involving breach of contract, allocation of clients and future competition where the amount in dispute exceeded £500,000.
  • Commercial contract – disputes relating to the breach of a multi party joint venture agreement where the amount in dispute was in the region of £1 million.
  • Employment – dispute between a senior employee and a substantial international organisation relating to breach of contract, disability discrimination and personal injury where the amount in dispute amounted to £1.4 million.
  • Personal injury – dispute regarding compensation for severe head injuries resulting from a road accident where the amount in dispute exceeded £2 million.
  • Clinical negligence – dispute arising from allegations of negligence over the birth of a severely disabled child where the amount in dispute exceeded £2 million.
